General Terms and Conditions of Sale (T&C)

Article 1 – Purpose and Scope
These T&C govern all sales concluded between Héléades Jewelry and any consumer making a purchase on the website. Acceptance of the T&C is confirmed by checking a box at the time of order. The applicable T&C are those in effect on the date of the order.
Article 2 – Information on Jewelry
Product sheets detail materials, stones, weight, and dimensions for informational purposes only. Slight variations are possible due to handcrafted manufacturing and screen display. Héléades Jewelry may modify its offer at any time without impact on orders already validated.
Article 3 – Jewelry Types
Unique non-customizable creations: unique artisanal pieces, non-customizable except for ring size adjustment.
Custom-made creations: creation according to Client specifications, prior quote, sketches and mockups, fabrication after quote acceptance.
Apprenticeship jewelry: certain pieces were created and entirely handcrafted by Lola Martin during her apprenticeship at Bijouterie Miailhes (114 route d'Albi, 31200 Toulouse). These pieces are sold under a sales agreement with a 20% commission for Héléades Jewelry. The collaboration has ended; no current fabrication for this workshop.
Article 4 – Order
4.1 Order Process
The Client selects articles, provides required information, chooses delivery method, verifies the summary, and validates the order after accepting the T&C. The order becomes final only after email confirmation and payment receipt.
4.2 Custom-Made and Quote
For custom-made fabrications:
A detailed quote specifies the total price and delivery times.
The Client pays a non-refundable deposit of 30% of the total amount upon quote validation.
Fabrication begins only after written acceptance of the quote and receipt of this deposit.
Any cancellation by the Client after quote validation results in irrevocable loss of the deposit.
4.3 Availability
In case of exceptional unavailability, Héléades Jewelry will offer an extended deadline, an exchange, or a refund. In the absence of agreement, the order for the unavailable item will be refunded.
Article 5 – Pricing
Prices are indicated in euros, all taxes included (VAT not applicable). Shipping costs and additional services are communicated before order validation. Héléades Jewelry may change its prices at any time, without effect on orders already placed.
Article 6 – Payment
Payment is due in full according to the following terms:
30% non-refundable deposit required upon quote validation for custom creations.
Remaining 70% due before jewelry shipment.
Payment methods: credit card, bank transfer, or other methods offered on the Site.
Payments are secured via the indicated service provider. In case of payment refusal, the order is cancelled.
Article 7 – Retention of Title
Jewelry remains the property of Héléades Jewelry until full payment of the price. Risk transfer occurs at actual delivery to the Client.
Article 8 – Delivery
8.1 Zone and Address
Delivery in mainland France to the address indicated by the Client.
8.2 Indicative Delivery Times
Unique creations: 2 to 5 business days
Ring size adjustment: 5 to 10 business days
Custom-made: according to quote (generally 4 to 6 weeks)
8.3 Transport, Tracking, and Insurance
Insured and tracked shipment (registered Colissimo or equivalent carrier). Tracking number communicated to the Client.
8.4 Reception
Upon receipt, the Client verifies the condition of the package and jewelry. In case of anomaly, specific reservations must be issued to the carrier and notified to Héléades Jewelry within 48 hours, with photographs.
Article 9 – Right of Withdrawal, Returns, and Exchanges
The Client has 14 days from receipt to exercise their right of withdrawal, except for:
Custom-made creations
Adjusted rings
Apprenticeship jewelry sold on commission
For eligible items, the request must be sent by email to contact@heleadesjoaillerie.com. Jewelry must be returned in original condition, unworn, with packaging and accessories, by tracked and insured mail, at the Client's expense. Refund occurs within 14 days of receipt and inspection, excluding initial shipping and return costs.
Article 10 – Conformity, Warranty, and Repairs
10.1 Legal Warranties: conformity warranty and hidden defects warranty.
10.2 Artisanal Warranty: 6 months for manufacturing defects (excluding normal wear, damage, unauthorized interventions).
10.3 Repairs: service available upon quote, return and outbound transport costs charged to the Client.
Article 11 – Intellectual Property
The Site's creations, designs, mockups, texts, images, and logos are the exclusive property of Lola Martin EI. Any total or partial reproduction is prohibited without written authorization.
Article 12 – Personal Data
Collected data is used for order execution and customer relations. It may be transmitted to service providers (hosting, payment, carriers). Data retention periods: 10 years for accounting data, 3 years for prospecting, 13 months for cookies. The Client has rights of access, rectification, erasure, opposition, limitation, and portability by writing to contact@heleadesjoaillerie.com.
Article 13 – Liability
Héléades Jewelry's liability is limited to the order amount. Exclusion of indirect damages, force majeure, and faults of the Client or carrier.
Article 14 – Mediation
In case of unresolved dispute, the Client may contact a consumer mediator or use the European ODR platform: https://ec.europa.eu/consumers/odr/.
Article 15 – Applicable Law and Jurisdiction
The T&C are governed by French law. French courts have jurisdiction over any dispute.
Article 16 – Miscellaneous Provisions
Partial nullity: if one clause is void, the others remain enforceable. The T&C may be modified; those in effect are those accepted at the time of order.
